Terms and Conditions of Sale (T&C)
1. Subject:
These Terms and Conditions of Sale are intended to define the contractual relationship between HOMELIVIA and the customer, as well as the terms applicable to any vehicle rental made through the website www.rivieradriveexperience. The purchase of a product through this website implies the customer’s unconditional acceptance of these Terms and Conditions of Sale, which the customer acknowledges having read prior to placing an order. Prior to any transaction, the customer declares, on the one hand, that the rental of a vehicle with or without a driver on the website www.rivieradriveexperience is limited to strictly personal use and, on the other hand, that they possess full legal capacity, enabling them to enter into an agreement under these general terms and conditions of sale.HOMELIVIA reserves the right to modify these terms and conditions of sale at any time to comply with any new regulations or to improve the use of its website. Consequently, the applicable terms and conditions will be those in effect on the date the buyer places the order.
2. Services Offered:
The services offered are those listed on the HOMELIVIA website (www.rivieradriveexperience), subject to availability. HOMELIVIA reserves the right to modify the range of services at any time. Each service is presented on the website with a description containing key details: tour description, date, departure location, and number of seats. A minimum of 4 people is required for departure, and a maximum of 6 people for each tour in the Topolino Dolce Vita. A minimum of 4 people and a maximum of 6 people are required for the Combi-Van. One additional seat may be available upon request in the guide’s car or next to the driver of the Combi-Van. For regular tours: Departure from the meeting point indicated on the tour description page (unless otherwise specified due to roadwork or events on the route).We reserve the right to modify all or part of the itinerary if necessary, depending on sporting or other events, or any road changes or closures by the police in the cities or towns we pass through. For tours that include lunch, a picnic, or dinner, we use service providers who strictly adhere to health guidelines. If you have any food intolerances, it is your responsibility to inform us at the time of booking. Participants must be at least 18 years old to consume alcohol and must under no circumstances be the driver of the vehicle. None. And we remind you that alcohol abuse is dangerous for your health. Please drink responsibly.
3. Reservation:
Reservations can be made online on our website, by phone, or in person. The reservation is confirmed upon receipt of full payment. By making a reservation, the customer acknowledges that they have all the necessary information regarding the nature of the service offered, the details of which can be viewed on the Riviera Drive Experience booking website. The customer therefore confirms their reservation with full knowledge of the service offered and may not, under any circumstances, dispute its suitability for their needs.
4. Rates:
The prices listed on the online store are in euros (€) and include all taxes (TTC), reflecting the applicable VAT rate on the date of the order. Any change in the VAT rate may be reflected in the product prices. HOMELIVIA reserves the right to modify its prices at any time; however, the price listed on the store on the date of the order will be the only one applicable to the customer.
5. Ordering and Payment Terms:
HOMELIVIA allows its customers to order and pay for its services through the platform integrated into its website. The customer selects the services they wish to order and adds them to the “cart,” makes any necessary changes (quantity, product codes, etc.), and reviews their information.The next step prompts the customer to review all the information, read and accept these Terms and Conditions by checking the corresponding box, and then confirms the order by clicking the “Confirm My Order” button. Finally, the customer is redirected to a secure interface powered by Stripe to safely enter their personal credit card information. If the payment is accepted, the order is registered and the contract is definitively formed. In the event of fraudulent use, the customer may request cancellation of the card payment, and the amounts paid will then be credited back or refunded. Payment may also be made on-site directly to the guide. The credit cardholder is not liable if the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card.To obtain a refund for the fraudulent charge and any bank fees the transaction may have incurred, the cardholder must dispute the charge in writing with their bank within 70 days of the transaction, or up to 120 days if the contract between the cardholder and the bank provides for this.The amounts debited will be refunded by the bank within a maximum of one month after receipt of the written dispute filed by the cardholder. No fees for the refund of the amounts may be charged to the cardholder. Confirmation of an order implies acceptance of these terms and conditions of sale, confirmation of full knowledge thereof, and a waiver of the right to invoke one’s own terms and conditions of purchase.All data provided and the recorded confirmation shall serve as proof of the transaction.If the customer has an email address and has provided it on the order form, HOMELIVIA will send confirmation of the order’s registration via email. 6. Liability:
In the context of distance selling, HOMELIVIA is bound only by an obligation of means. The company shall not be held liable for any damage resulting from the use of the Internet, such as data loss, unauthorized access, viruses, service interruptions, or other unforeseen issues.HOMELIVIA makes every effort to ensure its customers a high-quality and safe experience. Despite these precautions, HOMELIVIA cannot under any circumstances be held liable for costs related to delays resulting from circumstances beyond its control, such as adverse weather conditions or traffic delays. Furthermore, HOMELIVIA is not liable for the theft or loss of personal belongings inside or outside the vehicle during the tour, or at the departure and arrival locations during the tour. HOMELIVIA cannot be held liable for accidents, injuries, losses, or damages occurring during tours, excursions, and sightseeing trips,
7. Insurance:
Customers are encouraged to purchase personal insurance covering the risks associated with the activities offered. SARL HOMELIVIA holds professional liability insurance.
8. Intellectual Property:
All content (text, photos, videos) provided by HOMELIVIA LLC is protected by intellectual property rights and may not be used without prior authorization
9. Code of Conduct and Compliance with Traffic Laws:
Any consumption of alcohol is strictly prohibited before and during the tour. The tour will be canceled without any possibility of a refund if the tour guide appointed by Homelivia suspects the presence of alcohol or narcotics. No exceptions will be made, and any participant found in violation will be immediately removed from the tour and must return home by their own means, whether by taxi or bus. Customers must behave impeccably in all respects; this includes any disturbance of public order, rudeness, excessive excitement, violation of public decency, or dangerous driving behavior. Failure to comply with the traffic laws in effect in France will result in the immediate termination of services by SARL HOMELIVIA, and no refund may be requested. The customer will be required to return home by their own means, leaving the vehicle with the guide.
10. Disputes:
These Terms and Conditions are governed by French law. In the event of a dispute, an amicable resolution will be sought before any legal action is taken. Failing that, the courts of Nice shall have exclusive jurisdiction. 13. Acceptance of the Terms and Conditions: By booking a service, the Customer unconditionally accepts these Terms and Conditions.
